Possession Of A Gun On Municipal Property

municipal law ann arborThe Michigan Supreme Court has ruled that a local school district may adopt a policy that prohibits the possession of a firearm on school property. The outcome of the case was in doubt considering prior appellate court rulings that a municipality may not establish gun-free zones on municipal property.

This new law distinguishes between types of premises and sets different rules for concealed versus open possession and for members of the public versus municipal employees.

Ease Family Disagreements During Funeral Arrangements

elder law ann arborNow, in Michigan, an individual can designate a funeral representative in a document separate from a will or power of attorney. The designation must be either witnessed by two people or notarized. A properly designated funeral representative has priority over all family members, including a surviving spouse, although the surviving spouse can be, and often is, designated as the funeral representative.

How Does Survivorship Work?

estate planning attorney ann arborDo you own property with your husband and or wife?
What happens if one of you dies?
Want to avoid probate?
As owners of real property owned as husband and wife, you have the rights of survivorship. If one of you dies, the survivor owns the property automatically and without the necessity of a probate proceeding. However, the right of survivorship is not applicable for the second of the spouses to die, so the surviving spouse is advised to speak with his or her attorney to decide if some action should be taken regarding he status of title to the property.

Should Your Home be Titled in the Trust Name or Your Name?

estate planning attorney ann arborThis is a question that is frequently asked by our clients while discussing their estate plan intentions and options. The answer is dependent on the facts of each case but, in general, there are good reasons to hold the title in the husband’s name and wife’s name, as husband and wife, rather than in their living trust name.

Victims of Workplace Harassment & Their Rights

One of the most common types of inquiries I receive is from people who claim they’re victims of workplace harassment instigated by a boss, supervisor or co-worker. Their most common question is if they can put an end to the harassment and recover money damages from the harasser.
Unfortunately, the situations that afford a harassed employee a right to threaten or take legal action against a harasser are legally limited. Talk to an experienced employment attorney in Ann Arbor today about your concerns. If someone is harassing you at work, at very least you should know your rights.
